These Terms of Use ("Terms") form a legal agreement between you and CSM Limited (trading as DivaGirl & DivaStreet) ("we", "us", "our"), the operator of divastreet.co.uk and divagirl.co.uk (together, the "Platform"). By creating an account or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility & Age Restrictions

You must be at least 18 years old to register for, or use, the Platform. By using the Platform, you confirm that you are 18 or older and that you have the legal capacity to enter into this agreement. We use age-verification measures on registration and on adult content, and we reserve the right to request further proof of age at any time. Any account found or suspected to belong to a person under 18 will be suspended immediately and reported to the relevant authorities.

2. Your Account

You agree to:

• Provide accurate, current information when registering and keep it up to date;
• Keep your login details confidential and not share your account with anyone else;
• Notify us immediately if you suspect unauthorised use of your account;
• Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information, impersonate another person, or are used in breach of these Terms.

3. Acceptable Use — Prohibited Conduct

We operate a zero-tolerance policy on the following. Any of this conduct will result in immediate account termination, removal of content, and, where appropriate, referral to law enforcement:

• Minors: any content, listing, profile, or communication that involves, depicts, sexualises, or solicits a person under 18, in any way whatsoever.
• Trafficking & exploitation: any listing or conduct connected to human trafficking, coercion, or the exploitation of any person, is strictly prohibited. We cooperate fully with law enforcement on any suspected case.
• Illegal services: advertising or soliciting any service that is unlawful in the jurisdiction where it is offered.
• Non-consensual content: sharing images, videos, or personal information about another person without their consent, including so-called "revenge" content.
• Fraud & scams: misleading listings, fake profiles, payment scams, or any attempt to defraud another user.
• Harassment & hate speech: threats, harassment, discrimination, or abusive conduct directed at another user based on any protected characteristic.
• Spam & malware: unsolicited advertising, automated posting, or distribution of malicious software or links.
• Impersonation: pretending to be another person, business, or authority.

This list is illustrative, not exhaustive. We may remove any content or account that we reasonably believe breaches the spirit of these Terms, even if not explicitly listed above.

4. Dating & Adult Services Listings — Additional Rules

Our dating and adult services categories exist to let independent, consenting adults advertise lawful services and connect with one another. To keep this space safe and lawful, the following additional rules apply:

• Listings in these categories may only be posted by the individual they relate to, or by someone with that individual's express, verifiable authorisation.
• We prohibit any listing that indicates a third party is controlling, managing for profit, or coercing the advertiser, in any way that would constitute an unlawful activity in the relevant jurisdiction.
• All advertisers in these categories may be required to complete additional identity and age verification before their listing is published.
• Listings must comply with all applicable laws in the jurisdiction in which the advertised service is offered. It is the advertiser's sole responsibility to ensure their listing is lawful.
• We actively moderate these categories and reserve the right to remove any listing, request further verification, or suspend an account without prior notice where we have reasonable grounds for concern.
• We encourage all users to review the safety guidance in our Help Center before arranging to meet anyone met through the Platform.

5. Content Ownership & License

You retain ownership of the content you post. By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform. This licence ends when you delete the content or your account, except where content has been shared with, or reported by, another user, or where we are required to retain it for legal reasons.

6. Listings, Moderation & Removal

All listings are subject to review and may be edited, rejected, or removed at our sole discretion, with or without notice, if we believe they breach these Terms, applicable law, or our internal content standards. We are not obliged to explain the reasons for a moderation decision, though we will generally do so on request.

7. Payments, Credits, Wallet & Subscriptions

Certain features — including premium listings, featured placement, and account subscriptions — require payment. Payments are processed through third-party payment providers and are subject to their own terms. Prices are displayed in advance of purchase. Unless otherwise stated, payments for digital features and services are non-refundable once the feature has been activated, except where required by law. Wallet balances and credits have no cash value outside the Platform and cannot be transferred between accounts.

8. Affiliate Program

Where available, our affiliate program allows members to earn commission by referring new users, subject to separate affiliate terms displayed within the affiliate dashboard. We reserve the right to withhold or reclaim commission earned through fraudulent, abusive, or self-referral activity.

9. Reporting & Enforcement

Every profile, listing, and message includes a reporting tool. We review reports as a priority, particularly those involving suspected minors, exploitation, or illegal activity, and will take appropriate action, which may include immediate suspension pending investigation. Knowingly submitting a false report is itself a breach of these Terms.

10. Suspension & Termination

We may suspend or terminate your account, with or without notice, if we reasonably believe you have breached these Terms, applicable law, or put the safety of another user at risk. You may close your account at any time through your account settings. Termination does not affect any rights or obligations that arose before termination, including our right to retain data as described in our Privacy Policy.

11. Disclaimers

The Platform is provided "as is" and "as available". We do not verify the truthfulness of listings or profiles beyond our stated moderation and verification processes, and we do not guarantee that any listing, service, or user is accurate, safe, lawful, or as described. You use the Platform, and interact with other users, entirely at your own risk. We strongly encourage you to follow the safety guidance in our Help Center.

12. Limitation of Liability

To the fullest extent permitted by law, we exclude all liability for any indirect, incidental, or consequential loss arising from your use of the Platform, including loss arising from your interactions with other users. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold us harmless against any claim, loss, or expense arising from your breach of these Terms, your misuse of the Platform, or your infringement of any third party's rights.

14. Intellectual Property & Copyright Complaints

All Platform branding, software, and design is our property or that of our licensors. If you believe content on the Platform infringes your copyright, contact legal@divastreet.co.uk with details of the content and your rights, and we will investigate promptly.

15. Third-Party Sites & Services

The Platform may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices.

16. Changes to These Terms

We may update these Terms from time to time. Where changes are significant, we will notify you before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of England and Wales.
